DEA: Seeds Easier to Mail Now.

DEA: Seeds Easier to Mail Now.

It has become possible for cannabis growers to purchase seeds legally from all
around the country without having to worry about getting in trouble. There was a
restriction on selling cannabis across the state. It was federally illegal to purchase
pot seeds from some other state, but it is no longer illegal.

It was in the last week Kyle Jaeger, a Marijuana Moment reporter, uncovered a letter
from DEA. It included the detailed clarifications and definitions of clones, genetic
material, tissue culture, and cannabis seeds. The letter has sparked the world of
cannabis majorly because it can open the doors for new opportunities for US Seed
banks. This will also enable the growers to get their hands on diverse strains from
across the country. Ultimately, we will see new trends concerning cannabis in the
market.

This gives us a hint that popular marijuana strains in the markets of California and
Washington can now make their way to markets of Maine, New York, and New
Jersey legally.

Drug Enforcement Administration (DEA) has recently recognized that the seeds of
marijuana plants are legal, and they can be shipped from one state to another
legally. This gives us a hint that seeds of popular strains can make their way to the
market and can be mailed to other states.
The 2018 Farm Bill has legalized hemp and kept it aside from marijuana. As long as
a plant doesn’t contain more than 0.3% THC, it will remain uncontrolled. Similarly,
marijuana seeds that have a concentration of THC less than 0.3% are not covered
by the CSA.
Normally, both the hemp and marijuana seeds have a THC concentration of less
than 0.3%. Considering this, the seeds of both plants are legal to sell and purchase
no matter how much THC the plant will produce resulting from that seed.
Mailing Weed Drug trafficking through the mail is considered a big offense in the states for which
thousands of people have been arrested in the past. Finding the exact figure can be
difficult, but the postal inspectors have discovered thousands of parcels with around
50,000 pounds of weed.
Though legal in the US with some conditions, cannabis is still illegally trafficked
around the US. Since different states have different laws regarding marijuana
legality, people don’t bother considering those and end up being caught by the
authorities.
However, it has also been noticed that the level of cannabis being trafficked has
come down to a great extent in the past few years. The major reason is the legality
of cannabis with less than 0.3% THC. This has given people an opportunity to stick
to cannabis in a legal way. Also, with the increasing awareness, more stores are
opening up in different states, thus bringing down the weed mailing to a great
extent.
With the recent publication of the DEA’s letter on pot seeds, it is now legal to mail
weed from state to state. Of course, there are some conditions that should be
fulfilled for carrying out the pot seed mail. The main condition is less than 0.3% of
THC in the seeds, no matter what their source is.
What exactly are Material and Sources?

The use of hemp for industrial purposes was legalized back in 2018. With the
passing of the Farm Bill, hemp can be used for the production of textiles and
cannabinoids, including delta-8 THC. Delta 8 is a cannabinoid that can be extracted
easily from plants with less than 0.3% THC. Shane Pennington, counsel at Vicente
Sederberg LLP in NY, asks to clarify what can and cannot be extracted from
cannabis plants. The DEA letter clarifies that genetic material, tissue culture, or any
other substance extracted from hemp is not covered by CSA as long as it has a
delta-9-tetrahydrocannabinol concentration of less than 0.3%.
The pot seeds have been considered illegal due to their source. Since their source
contains more than 0.3% THC, they were illegal to sell. But Pennington made a
statement that the legality of seeds should not be based on their source but rather
on the percentage of THC in the cannabis seed itself. Concerning this, any seed with
less than 0.3% THC is hemp and is federally legal.
“When it comes to determining whether a particular cannabis-related substance is
federally legal ‘hemp’ or schedule I “marihuana,” it is the substance itself that
matters—not its source,” Pennington wrote in a blog post.
Its Effects on the Cannabis Industry

If it really becomes legal to mail pot seeds across the borders, it will give a better
chance to marijuana enthusiasts to get their hands on different cannabis strains
from all over the country. Instead of being confined to a certain state, the strains
can be moved and grown across the country legally. This will ultimately spark the
world of cannabis resulting in innovation and better opportunities for the United
States seed banks.
It will be easier to treat certain medical conditions with more access to strains by
growing strains for that disorder. The probability of cannabis production for
recreational purposes also increases at the same time.
More flexible transport options will play a bigger part in the rise of the cannabis
industry. As it will become easier for us seed banks to access and grow different
strains, the likelihood of public demand for certain flavours and strains will also
increase.
In Conclusion The control status of all the material extracted or derived from the cannabis plant
relies completely on the delta-9 THC concentration. The rule goes for genetic
material and tissue culture as well. The whole argument can be wrapped with the
statement that the origin or source of the seed doesn’t matter. Whether the
material will be covered by CSA or not is determined by the presence of delta-9 THC
in that substance. A substance having less than 0.3% THC on a dry weight will be
considered hemp and will not remain under CSA control. Simultaneously, a
substance with more than 0.3% THC constitutes marijuana, and it will be covered by
CSA.
